The Victorian government has introduced a commercial tenancy relief scheme to help alleviate financial hardship faced by commercial tenants and landlords as a result of coronavirus (COVID-19).

Eligible Victorian commercial landlords and tenants.

Overview

For commercial tenants and landlords, the scheme will provide the following support:

  • a freeze on commercial tenancy evictions until 28 March 2021, for the non-payment of rent for small to medium enterprises, with an annual turnover under $50 million that have experienced a minimum 30% reduction in turnover due to coronavirus (COVID-19)
  • freeze on rent increases during the ban period for commercial tenants
  • a rental payment waiver or deferral proportionate to commercial tenants’ income reduction due to coronavirus (COVID-19), to be negotiated between tenant and landlord
  • A free mediation service for commercial tenants and landlords accessed through the Victorian Small Business Commission (VSBC), to resolve disputes over rent relief
  • the option for commercial tenants to apply to the VSBC for a binding order for rent relief, if their landlord fails to respond to the VSBC, or doesn’t engage in mediation in good faith

Additionally, land tax relief will be available to commercial landlords who 'pass-on' rent relief to their tenants, provided the tenant:

  • has an annual turnover that does not exceed $50 million
  • is an eligible business in the Commonwealth’s JobKeeper program, and
  • is suffering financial stress or hardship as a result of the pandemic
