Privacy Collection Statement for the Venture Capital Limited Partnerships (VCLP) Application Form
The Department of Industry, Science and Resources (the department) is bound by the Australian Privacy Principles (APPs) outlined in the Privacy Act 1988 (Cth) which regulates how entities may collect, use, disclose and hold personal information. This collection statement and the department's Privacy Policy set out what we will do with any personal information the department collects. General partners completing this form and applying on behalf of a partnership must ensure each partner in a partnership and each key personnel referred to in the application are aware of the collection, use, disclosure and storage of the partner's or key personnel's personal information, as set out in this statement.
Personal information can include names, email addresses, telephone numbers, employment positions and information contained in curriculum vitae.
Collections and Use
Your personal information you provide about others is being collected by the department to carry out functions given to Industry Innovation and Science Australia (the Board), the Innovation Investment Committee and the department under the Venture Capital Act 2002 (Cth) and related legislation (venture capital legislation). Personal information obtained will only be used for the purposes related to these functions. These functions include:
- assessing Venture Capital Limited Partnership (VCLP) applications;
- registering and deregistering VCLPs under the venture capital legislation;
- performing administrative and decision making tasks associated with the registration and maintenance of VCLPs;
- assessing the accuracy of reported information for taxation purposes;
- data matching with other datasets such as Australian Securities & Investments Commission (ASIC) and Australian Business Register (ABR) for education and compliance activities where authorised or required by legislation; and
- reporting on program process to the Minister and the public.
Consequences of not providing personal information
If you do not provide the requested personal information, we may not be able to process your application or notify you of certain information or outcomes. This could result in delays or the inability to access certain services or benefits.
Disclosure
The personal information of the fund manager's contact will be made public. The information may also be disclosed where authorised or required by law, such as to:
- staff and contractors in the department;
- members of the Board and its committees;
- the Minister/s with responsibility for the venture capital programs; and
- other Commonwealth, state and territory government agencies, in particular the Australian Taxation Office, the Department of Home Affairs, ASIC and the Australian Federal Police.
The department does not disclose your personal information to overseas entities. All data processing and storage activities are conducted within Australia, in compliance with applicable data protection laws.
